1 Image Copyright Responsibility

Alpha Matrix Web Design purchase copyright images from 3rd party services on behalf of there clients from 3rd party services like iStockPhoto.

The iStockPhoto terms of use of these images are adhered to strictly by Alpha Matrix Web Design. An Alpha Matrix Website client has a responsibility to adhere to the iStockPhoto terms of use as provided by iStockPhoto and should never breach these conditions by using the images in other locations without purchasing additional image licensing rights.

2 Reproduction Responsibility

Alpha Matrix Web Design reserves the right to not take responsibility for any 3rd party reproductions, such as, the print quality resultig from a PDF downloaded from one of our websites, or, from the display of emails that have been sent from one of our websites or from our email service, or, from the display of SMS messages sent from our 3rd party SMS provider and displayed by various mobile phone brands.

3 Website System Access

Alpha Matrix Web Design does not allow client access to our servers using cPanel, FTP or any other means. All FTP based issues can be resolved by our support team.
Alpha Matrix Web Design also reserves the right to not allow client access to our WordPress systems at the administration level for the following reasons -

  1. It can potentially lead to serious damage to a website’s  systems when changes are made without proper knowledge.
  2. Alpha Matrix Web Design provides support services to make any necessary changes at an administrators level at low cost to the client.
  3. Alpha Matrix Web Design reserves the right to protect their copyrighted system by not allowing clients to access the administration systems.

All clients have access to their website system content and are responsible for all changes they make including the creation of other users and the changes other users make.

4 Email, Tutorials and FAQ Support

Alpha Matrix Web Design provide unlimited advice to help clients manage their website. We do, however, reserve the right to refuse advice on the grounds of -

  1. Abusive or harassing language
  2. Intention to damage systems
  3. Refusal to accept an answer

Alpha Matrix Web Design Assisted Support Credits are used whenever a support team member must log into a client’s website to perform a task on their behalf. Alpha Matrix Web Design reserves the right to charge support credits for -

  1. Tasks that the client can do themselves when they login to their system
  2. Some tasks that can only be performed at a WordPress administrator’s level

Alpha Matrix Web Design reserves the right to decide how many credits they wish to charge per request and when a request becomes a customised upgrade and not a support credit task. If a task is performed and credits are not charged, this does not mean that the same tasks can be performed without charge upon request by a clients because Alpha Matrix Web Design will often perform assisted support without charge when they are less busy, but always reserve the right to charge for assisted support at anytime.

5 Upgrades and Customised Changes

Alpha Matrix Web Design reserves the right to quote any price and request payment in full without a guarantee before starting and finishing a requested upgrade.
If for any reason, the requested upgrade fails in any way technically, the client is entitled to a full refund and will be reimbursed the full amount and their website returned in good working order.
Alpha Matrix Web Design also reserves the right to refuse a refund request based on whether the client believes that the artwork is not to their liking. Any subjective graphics or other content does not qualify the client to request a refund.

6 Migrating to a New Server

Alpha Matrix Web Design reserves the right to refuse a clients request to move their Alpha Matrix Website to another server for the following reasons -

  1. The setup and hosting fees that we charge is on the condition that the client’s website is hosted on one of our servers in our network setup
  2. If a Alpha Matrix Website was migrated to another site a client would also have access to, and the ability to sell our copyrighted website system
  3. Alpha Matrix Websites can however, export their content using the WordPress export and import functions to transfer all page content and images

7 Billing & Cancellation Conditions

Alpha Matrix Website clients can cancel anytime they want without further obligation. If they are late on a payment, our online payment gateway system will continue to request payment for 1 month, after 1 month a client’s website system will be suspended until further payment, after 30 days of suspension, a client’s website system can be terminated. Alpha Matrix Web Design will try to contact clients when their payments are overdue to resolve the billing before canceling a clients account completely, however, it is always a clients responsibility to make sure that payments are up to date and Alpha Matrix Web Design does not take responsibility for any losses incurred by failed payments by a client and the communication concerning non-payment.

8 Right to Remove Content and Websites

Alpha Matrix Web Design reserves the right to remove specific content or an entire website at anytime for the following reasons -

  1. Containing content that may be illegal and is directly prohibited or suggestive of illegal activity in any way.
  2. Content that is not illegal, but results in a large number of complaints due to the content being widely viewed as inappropriate.
  3. Containing content that is seen to be defamatory to Alpha Matrix Web Design, any of our business partners, or any of our website clients.

9 Website System Content Responsibility

Alpha Matrix Web Design reserves the right to not take responsibility for content that is created by a client or by Alpha Matrix Web Design, either when a template is purchased or a task or upgrade is performed. A client must always take responsibility for all content on their website including the Tips & Tricks, the Privacy Policy, the Terms & Conditions, all page content, vouchers, certificates and print artwork. Alpha Matrix Web Design does not take responsibility for any complaints or lawsuits made by anyone who visits a client's website or reads any materials connected to the client's website. Alpha Matrix Web Design clients are always responsible for reading and checking their own content and can edit their content at anytime.

10 Terms of Service Adjustments

Alpha Matrix Web Design reserves the right to update, adjust or change in any way the conditions of the Terms of Service with full intentions to continue to follow proper legal and fair business practices. If the conditions of the Terms of Service come into dispute, due to different geographical laws, Alpha Matrix will try to satisfy their clients regardless of their international location, however, the current country that Alpha Matrix Web Design is located in will be the final determining factor to which laws are followed in the Terms of Service. Currently, Alpha Matrix Web Design is located in Australia and recognises international copyright laws.
